and LINDA LOU LIBUTTI,
Petitioners,
vs.
DEBORAH KAY FOLTZ SAUBAIN,
CYNTHIA ANNE FOLTZ ACKERMAN,
PETER ADRIAN FOLTZ,
ROSA MARIE FOLTZ,
and any UNKNOWN HEIRS OF
DONALD K. FOLTZ, SR and
PAULENE V. FOLTZ,
Respondents,
CIVIL ACTION NO.: 21-C-6
ORDER OF PUBLICATION
STATE OF WEST VIRGINIA,
COUNTY OF HARDY, to wit:
The. object of the above styled Civil Action is to Petition the Court so that a ruling may be made and an Order filed, wherein it will be stated that Arthur Thomas Strawderman, Nancy Louise Lanham, Daniel Lee Strawderman and Linda Lou Libutti are deemed the fee simple title owners, via the doctrine of adverse possession, of a certain tract or parcel of real estate containing 32 acres, more or less, located in the Lost River District, Hardy County, West Virginia and being the same tract of land that was presumed to have been rightfully conveyed unto them by that certain Deed from Joshua H. Slaughter,Jr., elated September 27, 1.972 and of record in the Office of the Clerk of the County Commission of Hardy County, West Virginia in Deed Book 130, at Page 257.
At issue is the fact that said Deed stated Joshua H. Slaughter, Jr. received title to said real estate by Deed from Donald K. Foltz, Sr. and Paulene V. Foltz, however upon review of the Hardy County land records, said Deed was never placed of record to verify said claim. Therefore, the last known fee simple title owners of the subject property would be Donald K. Foltz, Sr. and Paulene V. Foltz, who both departed this life as residents of Hardy County, West Virginia.
It appearing, by Affidavit filed in this action, that there may be persons who could have an interest or may be affected by the decisions in this action and whose names and addresses are unknown to the Petitioners; it is hereby Ordered that each person which claims to have an interest in said property appear and serve upon
Petitioners’ attorney, James 0. Heishman, whose address is 204 North Elm Street, Moorefield, WV 26836, an Answer or other defense to the Complaint filed in this action on January 8, 2021; otherwise, judgment by default may be taken against them at any time thereafter.
A copy of said Complaint with a more particular description of the subject property can be obtained from the undersigned Clerk at her office located in the Hardy County Courthouse at 204 Washington St. #111, Moorefield, WV, 26836.
Entered by the Clerk of said Court this 10 day of February, 2021.
