Less than five months into his term, Hardy County Prosecuting Attorney Jeff Weatherholt is expected to resign, according to a “Notice of Special Meeting of Hardy County Commission” issued by County Clerk Loretta Humbertson early Friday afternoon.
The special meeting will take place on Wednesday, April 23 at 10 a.m. in the Hardy County Commission office located at the courthouse.
The agenda includes just two items: 1) to announce receipt of the notice of resignation from Prosecuting Attorney Jeff Weatherholt; and 2) to appoint a Prosecuting Attorney to fill the unexpired term of Mr. Weatherholt.
According to West Virginia State Code a vacancy in the office of prosecuting attorney “shall be filled by the county commission within thirty days of the vacancy by appointment of a person of the same political party as the officeholder vacating the office.”
According to Clerk Humbertson, the resignation is not official until Weatherholt presents it to the Commission at the special meeting.
Given the early closure of the courthouse for the Easter holiday weekend, no further information was available by press time.
